What is property damage?
It is any deliberate degradation or deterioration of property, without there necessarily being theft or a break-in. It may concern:
  • A smashed window,
  • A tagged wall,
  • A ripped-out letterbox,
  • A forced lock,
  • A damaged fence,

Even if there was no break-in or theft, these acts are punishable and can be the subject of a complaint.
Can I file a complaint even if I did not see the offender?
Yes. You do not need to have seen or identified the person responsible in order to file a complaint. You simply need to describe the facts (damage observed, approximate date, place) as best you can.
Is it useful to file a complaint for minor damage?
Yes. Even an isolated or minor act (e.g. graffiti, a dented letterbox) deserves to be reported. It allows you:
  • to assert your rights with your insurer,
  • to inform the local authorities,
  • to help identify repeated behaviour (neighbourhood vandalism, targeted nuisance, repeated acts).
Can I declare damage that occurred in a building or a co-ownership?
Yes, if you are directly concerned (owner, tenant, representative of the co-ownership or the property manager). You can declare damage affecting a common or private part.
What if I do not know exactly when the damage occurred?
That is very common. Simply indicate the estimated date range (e.g. “between Saturday evening and Monday morning”). The authorities will be able to cross-check this information with any other complaints or reported facts in the same period.
